The purpose of this investigation is to analyze the effects and economic consequences of limiting the request for VAT refunds to international gold traders in Colombia who, in accordance with paragraph 3 of article 850 of the tax statute, acquire this metal from suppliers different from mining holders. Namely, delimiting the VAT refund to these types of companies directly affects cash flows, causing the purchase value of gold to the bartenders to change and the acquisition cost is lower, since the tax would not have the treatment of discounting generating Less resources in the operation of the organization. The above is evidenced in 2017, where a comparative analysis was carried out on an entity in the sector. The calculation of the value of the lien obtained was a discounted VAT of $ 520,000,000. With the application of this standard, only $ 52,000,000 could be requested, which produces an unfavorable variation of 90% in the recovery of discounted VAT.
Undoubtedly, the implementation of this measure in the mining sector puts at risk the operational sustainability of the marketers of said metal in the market and, even more, the activity of small miners affecting their economic exercise and their sources of family support. Finally, the study of this work is of a descriptive documentary, exploratory, analytical type, with a mixed approach and a financial scope.
