- Today homebuyers are unprotected against some kind of vices that emerge imperceptibly in their properties but over time progress progressively to generate structural failures that end up deteriorating or collapsing their residences. These defects are not covered by the mechanisms established by the Civil Code to hold sellers liable, such as rehibitorial action and the ten-year guarantee, because they do not constitute ruindefects or do not meet the conditions of required by these rules in order to be subject to legal protection. In the face of this situation, this research article explores the possibility of going to the real estate guarantee established by the Consumer Statute as an alternate route so that homebuyers can obtain the protection of their rights and hold sellers accountable for the progressive defects that their properties may present.
