- This paper explores the characteristics of digital work and performs an analysis of the reasons why it could be regulated under classical labor and employment law. The manifestations of legal subordination to which the service provider is subject, as well as the potential economic dependence, are explored in depth. The author also performs a balance of the sharp independence notes that the digital worker maintains, for example, the ability to decide when to work, during what periods, for which operating companies, etc. Having seen the two poles of the regulation of digital work - civil and labor -, the author proposes to create a new special regime for digital work that, from incorporating civil and labor rights and obligations, achieves an adequate balance for development of the digital industries, taking care of workers' rights.
