- Child's best interest principles, and the prevalence of their rights over the others' impose the State the obligation of guarantying a special protection to the under-age population on all aspects, which will facilitate its effective access to justice administration. However, this is a commitment that is not being fully fulfilled in Colombia, despite the fact that those injunctions implied all the legal system. However, this is not carried out as intended in practice. The reason of this issue lies in the fact that the criminal, civil, and family process can acknowledge a considerable protection of the children's rights. On the other hand, the administrative contentious process ignores the special treatment that under-age population deserves under constitutional provision. As a matter of fact, it is remarkable the need of establishing a differential treatment that leads to overcome the situations previously mentioned, and additionally, to guarantee the effective application of the constitutional injunctions.
