Descripción: Acoording with our Constitulional Court the right to water enjoys in our legal system the status of fundamental and it involves obligations to the Colombian State. However, despite such recognition, it was verified that there is an "Unconstitutional State of Affairs" against the right of water and by default, in this scenario of violation, there are damages that conform to the typology known as environmental damages (ecological and impure); which are atribule to the administration under the tille of imputation of negligence in the public service due to the omission in the fulfillrnent of the positive obligation of protection and materialization of the obligations of the State, being in this sense an inefficiency and inefficiency in compliance of the functions. In the face of reparation rneasures, apart from the traditional ones, it considers that in this case complex measures must be dictated in order to avoid repeating the facts that have rnade the damages, already mentioned.
