The study analyzes the causal link between the FTA and certain economic effects, which include changes in trade and investment flows, levels of output and employment, and commodities prices. The findings of this study indicate that while the said changes may prove largely beneficial to efficient producers in certain exporting sectors, some import-competing sectors are affected adversely. The consequent emergence of winners and losers in the economic context may trigger social impacts which are beneficial for certain groups on one hand, and crippling for others. The said social impacts are associated with the living standards of the population, food security, and community life. Additionally, the economic shifts may also lead to changes in the use of natural resources that emerge as both threats and opportunities for the environment.

In the Colombian context, which ideally will now start a post-conflict period, it is necessary for the government to pursue strategies to prevent the causes of the conflict. This study considers the hypothesis that one possible cause for future conflict is the problems that emanate from coexistence of social housing neighbours. In Colombia, social housing programmes focus on providing shelter, in the sense that it is understood as something only physical. The problem is that this notion ignores the need of people to generate community integration. This study takes a conceptual approach to the issue by addressing the debates around citizenship as an identity and active citizenship. It also analyses concepts such as social capital, state-society-synergy and finally community and social housing. The study focuses on the case of Colombia, analysing the context and the challenges of social housing. It evaluates the housing policy and community integration programs of different institutions of the national government. Finally, it concludes with the suggestion that the government should have a participatory approach to building social housing that will help with arraigo (attachment) and to form the social fabric to achieve community integration, accomplishing better conviviality and housing conditions.

Globalization has led legal systems to influence each other throughout history and legal transplants have not been immune to that process either. Nowadays we do not just see examples of legal transplants but come across cases of 'cross-fertilization' of case law. An emergence of unstudied trends that have spread around the world in a voluntary and involuntary way across legal cultures can also be witnessed. However it seems that legal transplants have been largely misunderstood and have been condemned as mere copy-paste exercises due to their history. This paper studies the different theories of legal transplants in comparative law and also analyses some particular cases that have eventually ‘worked’ efficiently both in the country of origin and in the country where those laws were adopted. We can no longer say that legal transplants are impossible; they are a reality we cannot run away from. Amongst the many challenges faced by this phenomenon, the primary one is to overcome all the obstacles imposed by a ‘legal globalization’ that is threatening developing countries by focusing more on the liberalization of markets, rather than on policies supporting social welfare. Despite this fact, there is still hope for a new concept of ‘legal globalization’, one that includes executing a serious study of the trends that not only developing countries are in need of, but also is a need of the developed countries, which is the adoption of policies towards social welfare, one of the biggest challenges that face modern legal comparatists today.

Sustainability-oriented innovation (SOI), which is innovation directed at improving social, environmental, and economic conditions, is being studied and used as a way to address the risks and opportunities organisations have in these three areas. This research explores the use of Performance Management (PM), meaning the strategy and processes used in organisations to define and improve performance, as a way to develop SOI capabilities in companies. The conceptual model used is based around four concepts: SOI, which describes what is to be achieved, organisations, or learning organisations, as the place where this can happen, PM, which explains how this can be accomplished, and individuals and teams as the central subject that describe who is this targeted for. The research was based on a literature review around these areas and a set of semi-structured interviews to managers and senior directors of large multinational organisations with innovation or sustainability related roles. Through the analysis and interpretation of this data, the results validated the effectiveness of PM to improve SOI in organisations, as well as uncovering six specific opportunity areas to leverage it more effectively. The latter are summarised as: purpose or vision offering direction, values that enable autonomy and celebrate trying, daring and shared goals, resources committed for the long run, sustainability literacy, and enabling business processes. The research contributes to the literature by outlining pathways to connect sustainability practices with other business practices, especially Human Resources, the area of study of PM. Additionally, it contributes to the practice of SOI by providing guidelines to identify and act on potential areas of opportunities to leverage on PM to develop SOI capabilities.

Food price surge : household welfare impacts in urban Colombia

From 2006 to 2008 the world was hit by major food price increases. The effects of these were felt worldwide and have been studied in several countries. The objective of this dissertation is to assess the specific impacts on urban households in Colombia and to quantify their welfare losses as well as the aggregate city poverty increases. Using total expenditures as a measure of household welfare, the study employs household survey information combined with disaggregated price data for the 13 main capital cities and 13 basic food commodities to address the proposed objectives. The analysis starts with the nominal adjustment of the poverty line caused by the increase in the basic consumption basket and then simulates short and medium term impacts of the price surge. These are measured in terms of monetary expenditure at the household level and using poverty headcount rate and poverty gap indicators at the aggregate level. The medium term increase in poverty is around 3%, both in the extreme and overall cases. However sub-national results vary significantly from these averages, being Barranquilla the city most affected. In addition, households with lower initial welfare and educational level, as well as female headed ones seem to be hit the hardest. These results could be applied to develop more efficiently targeted programmes directed to protect household entitlements towards a food price crisis. They could also be used to establish benefit levels or expansion directions of existing conditional cash transfer programmes that intend to improve nutritional and poverty conditions in Colombia. Finally the results become even more relevant considering the likely recurrence of events like these in the near future.

This research project is focused on bioprospecting activities in Colombia. As its main objectives, the research will describe and compare nature and biodiversity constructions among different social actors, analyse education and participation processes in three regions where bioprospecting research has been conducted taking into account benefit sharing, intellectual property rights and genetic access; and finally, identify knowledge and technology transfer of biopropespecting research in the three regions under study. Content analysis of media and documents along with ethnography will be conducted as research methods.

Development literature suggests that legal systems provide the framework for examining the main drivers of development. As one of the main legal tools through which lay citizens and companies can enforce contracts, the present analysis focuses on assessing the impact that the level of access to the legal system has on foreign investors’ decisions. Using a two stage least square (2 SLS) regression and data from the Rule of Law Index collected in 2009, this paper finds that the access to civil justice does not have a significant effect on Foreign Direct Investment. Further, the regression analysis indicates that the amount of taxes paid by the businesses as a percentage of commercial profits, the number of days to start a business and the Gross Domestic Product Per Capita are more important to attract foreign capital than the finding itself.

The following research seeks to identify the relationship between the classroom climate and school violence, through an intervention from the teaching of social sciences in the seventh grade of IED Altamira South East. It is a qualitative research under a case study method with ethnographic tools. The results showed that within the classroom climate there are situations of violence that interrupt and significantly affect coexistence and academic processes. The didactic intervention used a methodology from the immediate and immediate means of the students, since it helps them to understand that the social sciences are not knowledge of distant societies, but that they are part of that knowledge (Aguilera & Morales, 2009). This methodology allows the interaction between the environment in which students live and the knowledge of social sciences. The problems of violence that arise in a school allow us to interact and interact with the contents of the social sciences, generating knowledge, resistance and rejection in these situations. However, collective work is necessary to reduce, control and prevent these situations of violence, where the educational community assumes this responsibility with responsibility and commitment.

In common law jurisdictions, there is a preclusion rule, alien to most civil law countries, that prevents a party from raising subject matters that could and should have been brought in earlier proceedings. In certain common law jurisdictions, the rule is seen as part of the res judicata doctrine. Other common law jurisdictions classify this rule as part of the abuse of process doctrine. This rule aims at preventing multiplicity of processes, which may lead to contradictory decisions. By avoiding multiplicity of proceedings, the rule furthers the parties' interests in a definitive solution to their dispute and it also contributes to efficient and reliable justice administration. The question is therefore, whether the rule should apply in international commercial arbitration. Should the rule apply in international commercial arbitration it must be adapted to the particularities of the field. Because arbitration differs from litigation, the rule cannot be simply extrapolated from one field to the other. In order to facilitate the application of the rule in the international comercial arbitration arena, an international standard guiding the application of the rule would be beneficial.

Valuing beaches to develop payment for ecosystem services schemes in Colombia’s Seaflower marine protected area

The Colombian Seaflower marine protected area (SMPA) is the largest MPA in the Caribbean. The economy of the main island, San Andres (SAI) relies on tourism. This study conducted 1793 surveys to capture information about tourists’ experience and the value they placed on SAI’s beaches. Tourists considered beaches as the main reason for choosing SAI as a destination and expressed that they would be willing to pay additional money, US$ 997,468 annually, on top of what they had already paid for their vacation to protect SAI’s beaches. The study also showed how beach erosion could negatively impact economically the tourism sector of SAI, reducing revenue by 66.6% (estimated at US$ 73 million annually). This research contributed to the first stage in the development of a payment for ecosystem services (PES) scheme to protect SAI’s beaches. The importance of beaches for SAI and the potential loss of revenue due to beach erosion create an opportunity to incentivize the private sector to invest in natural infrastructure that maintains and protects beaches. This study also informs the potential application of valuation studies for the development of innovative financing instruments, such as PES, to achieve financial sustainability for the MPA network in Colombia.
