Legal certainly when it comes to ownership of rural property, becomes an absolute condition to overcome the property's informality phenomenon, and to effectively execute agricultura! policies, specially those related to rural social order. Thereupon, it is proposed a profound analysis of the diverse trends and positions, related to the accreditation of the property or legal entitling in the Colombian legal and regu latory framework. Such a topic seems to be extremely obvious, nevertheless, it is highly challenging, and around it an extended legal and jurisprudential debate which has lasted for more than a century, has arisen. This being the case, the most representative postures around de debate are complied, in an argumentative reconstruction exercise. This paper ends up proposing an alternative remedy, seeking coherence between several normative provisions on the matter, pointing out the existing inconsistencies found among the exposed postures, and how such contradictions can be overcome using the proposed thesis.
