The thesis does an analysis of the legal viability of PPPs in the energy sector.
PPPs are an instrument for public administration, which allows territorial entities, such as departments and municipalities, to implement and consolidate renewable sources - (FNCER in Spanish) in the energy matrix, especially in Non-lnterconnected Zones - (ZNI in Spanish), in arder to provide a public energy service effectively, efficiently and sustainably.
Public utilities legal entities might be legally allowed, as a contracting party or concessionaires, to participate in public and prívate initiatives as Public Prívate Partnerships - PPP, in a free competition market as a prívate investor.
lt is proposed that the prívate investor builds the energy infrastructure, using non-conventional sources of renewable energy - FNCER, within a regulatory framework that attends to ali the peculiarities of the sector, in order to get higher burdens to its standards as the service rates and the availability of the infrastructure.
