The intention of this thesis is to determine the warning signals and prevent actions to conduct successfully FARC DDR’s process. Although, Colombia has experienced multiple DDR processes during its recent history, the political violence continues to be rage with the country. After each process, Colombia notes the mutation of criminal structures, which have deployed their tentacles to other Latin American countries. Understanding the salient issues that led to the success or failure of DDR processes will aid the Government of Colombia (GOC) to faces the process with FARC. The main argument of this thesis is that, GOC; in order to carry out successfully DDR of the FARC must take into account DDR “best practices”, and experiences not only in Colombia but also in other countries. El Salvador and South Africa are the selected countries, due to some similarities that present their DDR’s experiences with some features of the Colombian conflict. This thesis also will cover past Colombian experiences in DDR from the end of La Violencia to most recent AUC’s DDR, as well as the “individual demobilization” programs for insurgents. In other words, an analysis of these cases will provide the best approaches to conduct a successful DDR process.

The main research question I explore is: What are the political and socio-environmental factors that can explain the Bogota’s river governance failure related to its pollution? To achieve this I analyse the relationship between society in the basin and the flow of water from a political ecology perspective. This work is divided in five sections, which includes a literature review relating the theories of the political ecology of the production of nature, common pool resource management, Tragedy of the Commons and governance. The scope of this work is limited to Bogota River’s basin in the spatial scale and the historical processes of the last 50 years. After evaluating the different interactions of the stakeholders and the river, I discuss that Bogota’s river has become a political object, using Robbins (2012) theses of political ecology. I arrive at this conclusion after analysing Bogota River’s situation following the flow of the water in spatial and temporal dimensions, seeing the production of nature (and in this case a polluted river as a result) as a historical spatial-ecological transformation that expresses the contradictions and tensions of modern times by the transformation of nature and society. I follow the water creating a narrative, to explore modernity as a geographical and socially contested project. Finally, I analyse how the sentence published in March 2014, by the Colombian State’s Council, currently tackles the issues that undermine good governance, identified in the rivers narrative and how it might help or hinder river restoration.

Globalization has led legal systems to influence each other throughout history and legal transplants have not been immune to that process either. Nowadays we do not just see examples of legal transplants but come across cases of 'cross-fertilization' of case law. An emergence of unstudied trends that have spread around the world in a voluntary and involuntary way across legal cultures can also be witnessed. However it seems that legal transplants have been largely misunderstood and have been condemned as mere copy-paste exercises due to their history. This paper studies the different theories of legal transplants in comparative law and also analyses some particular cases that have eventually ‘worked’ efficiently both in the country of origin and in the country where those laws were adopted. We can no longer say that legal transplants are impossible; they are a reality we cannot run away from. Amongst the many challenges faced by this phenomenon, the primary one is to overcome all the obstacles imposed by a ‘legal globalization’ that is threatening developing countries by focusing more on the liberalization of markets, rather than on policies supporting social welfare. Despite this fact, there is still hope for a new concept of ‘legal globalization’, one that includes executing a serious study of the trends that not only developing countries are in need of, but also is a need of the developed countries, which is the adoption of policies towards social welfare, one of the biggest challenges that face modern legal comparatists today.

Performance management for sustainability-oriented innovation = Gestión del desempeño para la innovación orientada a la sostenibilidad

Sustainability-oriented innovation (SOI), which is innovation directed at improving social, environmental, and economic conditions, is being studied and used as a way to address the risks and opportunities organisations have in these three areas. This research explores the use of Performance Management (PM), meaning the strategy and processes used in organisations to define and improve performance, as a way to develop SOI capabilities in companies. The conceptual model used is based around four concepts: SOI, which describes what is to be achieved, organisations, or learning organisations, as the place where this can happen, PM, which explains how this can be accomplished, and individuals and teams as the central subject that describe who is this targeted for. The research was based on a literature review around these areas and a set of semi-structured interviews to managers and senior directors of large multinational organisations with innovation or sustainability related roles. Through the analysis and interpretation of this data, the results validated the effectiveness of PM to improve SOI in organisations, as well as uncovering six specific opportunity areas to leverage it more effectively. The latter are summarised as: purpose or vision offering direction, values that enable autonomy and celebrate trying, daring and shared goals, resources committed for the long run, sustainability literacy, and enabling business processes. The research contributes to the literature by outlining pathways to connect sustainability practices with other business practices, especially Human Resources, the area of study of PM. Additionally, it contributes to the practice of SOI by providing guidelines to identify and act on potential areas of opportunities to leverage on PM to develop SOI capabilities.

This work examines the conditions that determine variations in urban transport sustainability outcomes in metropolitan areas of Latin America. Current theory suggests that building urban sustainability cannot just be a local technical dynamic; rather, it must be constructed and contested at various governance levels and through multiple political spaces. Similarly, theory posits that present urban policies are predetermined by previous decisions, which implies high reversal costs for making major changes to the system. Deviating from previous studies that have focused on analyzing urban sustainability technically, and at the local level, this study develops an empirical characterization of transport sustainability for Latin American metropolitan areas, and maps the political determinants of urban sustainability.

Nature and interpretation of the rule prohibiting parties from raising subject matters that could and should have been brought in earlier proceedings and its application in international commercial arbitration

In common law jurisdictions, there is a preclusion rule, alien to most civil law countries, that prevents a party from raising subject matters that could and should have been brought in earlier proceedings. In certain common law jurisdictions, the rule is seen as part of the res judicata doctrine. Other common law jurisdictions classify this rule as part of the abuse of process doctrine. This rule aims at preventing multiplicity of processes, which may lead to contradictory decisions. By avoiding multiplicity of proceedings, the rule furthers the parties' interests in a definitive solution to their dispute and it also contributes to efficient and reliable justice administration. The question is therefore, whether the rule should apply in international commercial arbitration. Should the rule apply in international commercial arbitration it must be adapted to the particularities of the field. Because arbitration differs from litigation, the rule cannot be simply extrapolated from one field to the other. In order to facilitate the application of the rule in the international comercial arbitration arena, an international standard guiding the application of the rule would be beneficial.
